- Personal data refers to all information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified directly or indirectly, particularly by reference to a specific identifier, such as a name, identification number, location data, online identifier, or by reference to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
- The Controller has not appointed a responsible person for the protection of personal data.
II. Sources and Categories of Processed Personal Data
- The Controller processes personal data that you have provided or personal data that the Controller has obtained based on fulfilling your Order.
- The Controller processes your identification and contact details and the data necessary for the fulfilment of the contract.
III. Legal Justification and Purpose of Processing Personal Data
- The legal justification for processing personal data is as follows:
- fulfilment of the contract between you and the Controller according to §13 Paragraph 1 letter b) of the Act,
- legitimate interest of the Controller in providing direct marketing (especially for sending commercial announcements and newsletters) according to §13 Paragraph 1 letter f) of the Act,
- Your consent to the processing for the purposes of direct marketing (especially for sending commercial announcements and newsletters) according to §13 Paragraph 1 letter a) of the Act in the event that no goods or services have been ordered.
- The purpose of processing personal data is as follows:
- fulfilment of your Order and the exercise of rights and obligations arising from the contractual relationship between you and the Controller; personal data required for the successful fulfilment of the Order (name and address, contact details) are required when ordering, the provision of personal data is a necessary requirement for the conclusion and performance of the contract, without providing personal data it is not possible to conclude the contract or for the Controller to fulfil it,
- sending commercial announcements and performing other marketing activities.
- From the Controller's side, there are no automatic individual decisions in the sense of §28 of the Act.
IV. Retention Period of Personal Data
- The Controller retains personal data:
- for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and the enforcement of claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
- for the duration until the consent for processing personal data for marketing purposes is revoked, for a maximum of 2 years, if the personal data are processed based on consent.
- After the retention period of personal data has expired, the Controller shall delete the personal data.
V. Recipients of Personal Data (Subcontractors of the Controller)
- Recipients of personal data are individuals:
- participating in the supply of goods / execution of payments based on the contract,
- facilitating the services for the operation of the e-shop (Woocommerce) and other services related to the operation of the e-shop,
- providing marketing services.
- The Controller intends to transfer personal data to a third country (a country outside the EU) or to an international organisation. Recipients of personal data in third countries are the providers of mailing services/cloud services.
VI. Your Rights
- Under the conditions set forth in the Act, you are entitled to:
- access your personal data according to §21 of the Act,
- rectify personal data according to §22 of the Act, or to restrict processing according to §24 of the Act,
- erase personal data according to §23 of the Act,
- object to processing according to §27 of the Act,
- exercise data portability according to §26 of the Act,
- withdraw consent for processing in writing or electronically to the address or email of the Controller specified in article III. of these terms.
- Furthermore, you are entitled to file a complaint with the Personal Data Protection Office of the Slovak Republic if you believe that your right to personal data protection has been violated.
VII. Conditions for Securing Personal Data
- The Controller declares that it has taken all appropriate technical and organisational measures to secure personal data.
- The Controller has taken technical measures to secure data storage and personal data storage in paper form, especially by using passwords and antivirus security software.
- The Controller declares that only authorised individuals have access to personal data.
VIII. Final Provisions
- By submitting an Order using the online order form, you confirm that you are familiar with the terms of personal data protection and that you fully consent to them.
- You agree to these terms by checking the consent box in the online form. By checking the consent box, you confirm that you are familiar with the terms of personal data protection and that you fully accept them.
- The Controller is entitled to change these terms. The new version of the personal data protection terms shall be published on the Controller's website and at the same time, the Controller shall send you the new version of these terms to your email address, which you have provided to the Controller.
These terms take effect on May 1, 2019.
